VMBoard Terms of Service

1. Acceptance of Terms

By accessing or using VMBoard services, including our vmctl platform ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please discontinue use of the Service immediately.

2. Our Service

VMBoard provides a comprehensive platform that streamlines server and virtual machine (VM) management through our vmctl service, offering secure connectivity, unified monitoring, and performance analytics.

Our service provides secure connectivity via our official apt package, which enables authorized remote access to your servers. The unified dashboard allows you to monitor CPU, RAM, disk, and network usage while providing secure terminal access.

Additionally, VMBoard offers detailed analytics to give you insights into server performance trends, helping you optimize your infrastructure effectively.

Whether your server has a public IP address or not, our apt package provides a consistent, secure connection method that works reliably across different network configurations.

3. Data Handling & Privacy

VMBoard is committed to protecting your privacy and maintaining the security of your sensitive information.

We do not store: Your SSH keys, server passwords, or any other sensitive authentication credentials. These remain exclusively under your control.

We only process: Basic machine information such as RAM, CPU specifications, and system architecture, along with connection metadata like session tokens and performance analytics data necessary for service functionality.

This data is used exclusively to provide and improve VMBoard services and is handled in accordance with industry best practices for data protection.

4. Security & User Responsibility

While VMBoard implements robust encryption and follows industry-standard security practices to protect our services, you maintain full responsibility for securing your servers, user accounts, and authentication credentials.

Important Security Notice:

VMBoard cannot guarantee protection from server misconfiguration, external attacks or security compromises, or data loss resulting from your own operations or third-party actions. You are responsible for implementing proper security measures on your infrastructure.

We strongly recommend maintaining regular backups, using strong authentication methods, and following security best practices for your server configurations.

5. Acceptable Use Policy

This Acceptable Use Policy describes material and activities that are not allowed in connection with VMBoard services. You are responsible for violations of this policy by anyone using your account with your permission or on an unauthorized basis.

5.1 Prohibited Activities

You may not use VMBoard services for any unlawful or abusive purpose, including but not limited to:

  • Illegal Activities: Any use to engage in, further, promote, or encourage illegal conduct or activities
  • Fraudulent Activities: Engaging in deceptive or harmful activities, offering fraudulent goods or services, or impersonating others
  • Intellectual Property Violations: Violating, infringing on, or misappropriating intellectual property rights of any third party
  • Harmful Content: Disseminating unlawful pornography, violent content, harassment, or content that threatens physical safety
  • Controlled Substances: Unlawfully selling or distributing controlled substances or illegal drugs

5.2 Security Violations

You may not use VMBoard services to violate the security or integrity of any network, computer, or communications system:

  • Harmful Software: Distributing viruses, malware, spyware, or any technology that may damage systems
  • Unauthorized Access: Accessing systems without permission or attempting to breach security measures
  • Data Interception: Monitoring data or traffic without proper authorization
  • Origin Falsification: Using fake or misleading headers or origin information

5.3 Network Abuse

Prohibited network activities include:

  • System Disruption: Monitoring, crawling, or harvesting content in ways that impair system functionality
  • Intentional Interference: Mail bombing, DoS attacks, flooding techniques, or deliberate system overloading
  • Unauthorized Services: Operating open proxies, mail relays, or Tor exit nodes without permission
  • Cryptocurrency Mining: Mining any cryptocurrency without explicit written permission from VMBoard
  • Identity Concealment: Withholding or cloaking identity or contact information

5.4 Email and Messaging Abuse

You must not distribute unsolicited mass email or spam. For legitimate bulk email:

  • Recipients must have given explicit consent (opt-in procedure required)
  • You must maintain privacy policies and complaint handling mechanisms
  • You must honor opt-out requests promptly
  • Source of emails must not be obscured

5.5 Resource Usage

You may not use VMBoard services in a way that unnecessarily interferes with normal operations or consumes a disproportionate share of system resources. We may require repairs to coding abnormalities that conflict with other users' service usage.

6. Limitations of Liability

To the fullest extent permitted by applicable law, VMBoard and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services.

This includes but is not limited to loss or corruption of your data, service downtime or connection issues, unauthorized access to your systems caused by factors outside our reasonable control, or any damages resulting from security breaches not directly attributable to our negligence.

You acknowledge and agree that you remain solely responsible for maintaining appropriate backups of your data, securing your credentials and access methods, and implementing proper server configurations and security measures.

Your use of VMBoard services is at your own risk, and you should ensure you have adequate backup and recovery procedures in place before relying on our services for critical operations.

7. Monitoring and Enforcement

VMBoard reserves the right to investigate any suspected violation of these Terms or misuse of our services. We may report suspected violations to appropriate authorities and cooperate with law enforcement agencies as required by law.

Consequences of Violations: If we determine that you have violated these Terms, we may remove content, disable access, suspend or terminate your account, or intercept traffic being used unlawfully. These actions may be taken even if violations are committed unintentionally or without your authorization.

8. Account Termination

VMBoard reserves the right to suspend or terminate user accounts and access to our services at our sole discretion for violations of these Terms of Service, security concerns, suspicious or malicious activity, or engagement in unlawful activities.

Where reasonably possible, we will attempt to provide advance notice of account termination, though we may immediately suspend or terminate accounts without notice if required for security reasons or to prevent harm to our systems or other users.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the applicable laws of Indian jurisdiction, without regard to conflict of law principles.

Any disputes, claims, or controversies arising from or relating to these Terms or your use of VMBoard services shall be subject to the exclusive jurisdiction of the competent courts in India.

By continuing to use VMBoard services, you acknowledge that you have read, understood, and agreed to these Terms of Service, including the Acceptable Use Policy contained herein.
